Zaando Innovations, Ltd. (“ Zaando ,” “ Zaando Go”, “ Zaando Go Driver”, “ Zaando Go Merchant”, “we,” “us,” or “our”) values your privacy and is committed to protecting your personal data. This starts with helping you understand our privacy practices.

This Privacy Policy explains how we collect, use, share, and protect information about you when you use our website, mobile app, and other services (collectively, the “Services”). By using our Services, you agree to the terms of this Privacy Policy.

1.     Scope

This policy applies to all Zaando users and specifically applies to:

  • Customers: individuals who request or receive orders and related services, including food, groceries, packages and other items via their Zaando Go account. This includes individuals who use guest checkout features without creating and/or logging into their Zaando accounts or those who receive orders placed by another Zaando Go user.
  • Drivers: individuals who provide deliver orders and items via their Zaando Go Driver account.
  • Delivery Drivers: individuals who provide delivery services via Zaando Go Driver app.
  • Merchants: Stores, Restaurants, other merchants and individuals who are owners, employees, contractors or representatives of these stores, restaurants or merchants.

All those subject to this notice are referred to as “users” in this policy.

Our privacy policy is subject to the Data Protection Act 2011 (TT). This means that we engage in the practices described in this policy if permitted under the laws of Trinidad and Tobago.

2.     Information We Collect

We collect information to provide and improve our Services. This includes:

(a) Information You Provide to Zaando

  • Personal Information:  We collect data when users create or update their Zaando accounts, or place orders via guest checkout features. This includes first and last name, email address, phone number, delivery address, payment information. For Delivery Drivers, this also includes vehicle or insurance, emergency contact information and background check information submitted during the application process, such as driver history, license status, government-issued identification and user-submitted profile photos.

  • Account Details:  Login credentials, preferences, and feedback.

  • Order Information:  Details about your orders, including items purchased and delivery instructions.

(b) Information We Collect Automatically During Use of Our Services

  • Device Information:  We collect data about the devices used to access our services, include the hardware models, IP address, browser type, operating system and version, device identifiers, software, preferred languages, advertising identifiers, device motion data and mobile network data.

  • Usage Data:  We collect pages viewed, links clicked, information related to the use of our Services, include time spent, types of services requested or provided. We also collect data about browser type, app crashes and other system activity.

  • Location Data:  We collect precise and approximate location data from Delivery Drivers’ mobile devices when the Zaando Go Delivery app is running in the foreground (app open and on-screen) or background (app open but not on-screen). We also collect precise and/or approximate location data from customers to provide accurate delivery services (if location tracking is enabled in the user’s device settings).

    Zaando collects such data from the time an order is requested until it is finished, and any time the app is running in the foreground (app open and on-screen). See “Choice and Transparency” below for information on how order recipients can enable precise location data collection.

    Order recipients may use the Zaando apps without enabling collection of location data from their mobile devices, however, this may affect certain features in the Zaando apps. For example, a customer who has not enabled precise location data will have to manually enter their delivery address.
     
  • Transaction Information: We collect transaction information related to the use of our services, including the type of services requested or provided; trip or order details (such as date and time, requested pick-up and drop-off addresses, distances travelled and items ordered, and payment transaction information (such as a restaurant or merchant’s name and location, amount charged, and payment method). We also associate a user’s name with that of anyone who uses their promotion code.

    This also includes information provided by users when placing their order, such as their allergies information.

  • Communications Data: We collect data regarding communications between users that are enabled through Zaando’s apps. This includes communication type (phone, text or in-app message), date/time, and content (including recordings of phone calls solely when users are notified of the recording in advance).

(c) Information from Third Parties

These include:

  • Referrals: Referred person’s data submitted by our users participating in our referral programs.

  • Payment Processors:  Transaction details when you make payments.

  • Marketing Partners:  Information about your interactions with our ads.

  • Vehicle Service Providers: Insurance, vehicle, or financial services providers for delivery drivers.

  • Compliance: Law enforcement officials, public health officials, and other government authorities.

2. How We Use Your Information

Zaando uses your data to support reliable orders and delivery. We also use the information we collect to:

  • Provide our services, support and respond to inquiries.
  • Personalize your experience and recommend products.
  • Process payments and prevent fraud.
  • Marketing and Advertising.
  • Improve our Services, including website and app functionality.
  • Comply with legal obligations.

Zaando uses the data we collect to:

  1. Provide our services, support and respond to inquiries . This includes using data to:
    1. Create and manage accounts
    2. Using location data to navigate order pickups and drop-offs, calculate delivery times and track the progress of deliveries.
    3. Match available delivery drivers to customers placing orders, including based on data such as location and proximity to other users and user settings/preferences.
    4. Calculate prices based on location data, order details, date, time, estimated distance and time, minimum base fees and other fees.
    5. Provide customer support, including investigating and addressing concerns.
    6. Enable communications between users on an order to clarify or request more information.

  2. Personalise your experience and recommend products. Personalise customers’ accounts by providing recommendations on stores and restaurants based on their order history and trending orders. We will also use the data for analysis, product development and research, to help us improve our services for our users.
     
  3. Process payments and prevent fraud . This includes:
    1. Processing payments and facilitate invoicing solutions, generating receipts and keeping users informed of changing company policies.
    2. Verifying users’ identities and compliance with safety requirements via background checks and other verification methods to ensure harmful and fraudulent accounts are screened out.
    3. Using user reviews, reported incidents and other feedback to promote the safe use of Zaando services.
       
  4. Marketing and Advertising. Zaando uses account, approximate location, trip and order history, to provide marketing and advertising communications. This may be in the form of sponsored app ad listings, emails, text messages, in-app notifications and push notifications.
     
  5. Improve our Services, including website and app functionality . Perform maintenance on our software and operations.
     
  6. Comply with legal obligations . We may use data to investigate concerns, reports, claims or disputes made by users relating to the use of Zaando’s services, to satisfy requirements under local or international laws, regulations, or pursuant to requests from law enforcement or the legal system.

3. How We Share Your Information

We do not sell your personal data. However, we may share it with:

  • Service Providers:  Delivery drivers, payment processors, background check, insurance and IT support providers.
  • Business Partners:  Restaurants and vendors to fulfill your orders.
  • Legal Authorities:  When required by law or to protect our legal rights.
  • Marketing Platforms:  For advertising and analytics purposes (e.g., Google Analytics).
  • Emergency Services: Police, Fire and Ambulatory services in the event of an emergency.

4. Data Security

We implement appropriate technical and organizational measures to protect your personal data from unauthorized access, loss, or misuse. However, no system is completely secure, and we cannot guarantee the absolute security of your information.

Zaando performs these activities above to ensure we fulfill our commitment to our users, in line with our company policies and agreements.

5. Data Retention

We retain your personal data only as long as necessary to fulfill the purposes outlined in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce agreements, in accordance with the Trinidad and Tobago Data Protection Act 2011.

6. Your Rights

Zaando enables users to access and/or control the data collected by Zaando . As a user in Trinidad and Tobago, you may have certain rights regarding your personal data, including the right to:

  • Access, correct, or update your personal data.
  • Request the deletion of your personal data.
  • Object to the processing of your personal data for marketing purposes.
  • Withdraw consent where processing is based on consent.

7. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to enhance your experience. You can control cookie preferences through your browser settings. Disabling cookies may affect the functionality of our Services. Cookies are used for authenticating users, remembering user preferences, tracking the popularity of content, and analyzing site traffic and trends.

8. Third-Party Links

Our Services may contain links to third-party websites. We are not responsible for the privacy practices of these websites. We encourage you to read their privacy policies before providing any information.

9. International Data Transfers

If your personal data is transferred outside of Trinidad and Tobago, we ensure that appropriate safeguards are in place to protect your information. This includes:

  • Securing user data when in transit, through encryption.
  • Implementing internal policies and procedures to limit access to, and use of, users’ data.
  • Limiting government and law enforcement access to user data, except where required by law.

10. Children’s Privacy

Our Services are not intended for individuals under the age of 18. We do not knowingly collect personal data from children.
